McGregor Woods Homeowner Survey

Welcome to the McGregor Woods Homeowner Association Survey, sponsored by the association's Board of Directors.

The purpose of this survey is to gauge the opinion of McGregor Woods Homeowner Association members on the replacement of the waterfront Gazebo that stood at the entrance to our community before it was destroyed by Hurricane Irma.

In order to help you make an informed choice, it's important you understand two sections of the Declaration of Covenants and Restrictions For McGregor Woods.

The first is section (9.12) which describes the Boards responsibility to repair, restore and rebuild when loss or damage occurs to the Common Areas or Association property. Below is the full verbiage for this section:

Section 9.12 Damage to Common Areas: Where loss or damage occurs to the Common Areas or Association property, it shall be mandatory for the Association to repair, restore and rebuild the damage caused by the loss, and the following procedures shall apply:

(A) The Board of Directors shall promptly obtain reliable and detailed estimates of the cost of repair and restoration, and shall negotiate and contract for repair and reconstruction.

(B) If the proceeds of insurance and available reserves are insufficient to pay for the cost of repair and reconstruction of the Common Areas, the Association shall promptly, upon determination of the deficiency, levy a special assessment against all lot owners for the deficiency. Such special assessments need not be approved by the lot owners. The special assessment shall be added to the funds available for repair and restoration of the property.

The second is section (13.2) which describes the community's right to ask for amendments to the Declaration of Covenants and Restrictions For McGregor Woods. Below is the full verbiage for this section:

Section 13.2 Amendments by Members: Except as otherwise provided herein or by law, this Declaration may be amended at anytime by the affirmative vote of at least two-thirds (2/3rds) of the voting interests present and voting, in person or by, proxy, at a duly called meeting of the members of the Association. A copy of each adopted amendment shall be attached to a certificate that the amendment was duly adopted as an amendment to the Declaration, which certificate shall identify the Book and Page of the Public Records where the Declaration is recorded, and shall be executed by the President of the Association with the formalities of a deed. The amendment shall be effective when the certificate and copy of the amendment are recorded in the Public Records of Lee County, Florida.
